The development we were watching earlier today has now moved materially forward. On September 16, 2026, the U.S. House passed the bipartisan Ratepayer Protection Act by an overwhelming 417–3 vote. The measure is aimed at preventing the electricity and infrastructure costs created by large AI data centers from being shifted onto ordinary utility customers.

Two developments stand out this morning, and both are directly relevant to West Texas.

First, Texas has moved from asking data centers about water use to threatening enforcement for failure to report it. Second, Anthropic, Cipher Digital and Fluidstack have committed $10 million to Colorado City's municipal water system even though their Barber Lake AI campus does not use the city's drinking-water supply.

A group of 31 Texas House members has formally urged the Public Utility Commission to pause major portions of the Permian Basin Reliability Plan, including the planned 765-kV transmission system, citing concerns over landowner notice, transparency and the compressed approval process. The letter was filed just before a PUCT meeting and significantly broadens the political opposition beyond a handful of individual lawmakers.

New reporting from the Produced Water Society conference in Midland says the Permian is currently generating roughly 21 million barrels of produced water per day, with volumes projected to reach approximately 28 million barrels per day by 2036. Disposal constraints, rising formation pressures and tighter injection-well permitting are increasing the need for large-scale beneficial reuse.

A new POWER Magazine report published August 7 cites Bloomberg NEF analysis estimating that Governor Abbott's data-center audit could affect approximately 49.8 GW of proposed data-center load and potentially add up to $15 billion in costs if projects experience significant delays. The pause applies while ERCOT and the PUCT verify projects moving through the interconnection process.

Atlas Energy Solutions and Kodiak Robotics announced plans to expand their autonomous trucking operation in the Permian Basin from 28 driverless trucks to 100 by mid-2027. The expansion includes a second autonomous operations depot supporting Atlas’ Dune Express sand logistics network.

The most consequential development is the rapidly escalating political challenge to Texas’ proposed 765-kV transmission buildout. Senior state leaders are now calling for current applications to be rejected or paused while the approval process is rewritten. Because the project is intended to move more electricity into West Texas, any delay could affect oilfield electrification, industrial expansion, AI infrastructure and data-center siting across the Permian Basin.
